NLRB Posting Requirement Enjoined
We reported in our December 28, 2011 Alert that the NLRB had agreed to postpone the effective date of its final rule requiring employers to post a notice informing employees of their right to organize under the National Labor Relations Act to April 30, 2012. The postponement had been at the request of a federal court in Washington, DC, which is hearing a legal challenge regarding the rule.
Now, in light of conflicting decisions at the district court level, the DC Circuit Court of Appeals has temporarily enjoined the NLRB's rule requiring the posting of employee rights. As such, the NLRB has announced that the rule will not take effect on April 30, 2012 as previously announced.
