White Collar & Regulatory Defense

The White Collar & Regulatory Defense practice group has extensive experience conducting internal investigations and advising corporations and other business entities in responding to law enforcement agencies. We have successfully guided numerous corporations through criminal investigations and regulatory enforcement proceedings as well as developed internal controls and security programs that minimize the potential disruption to our clients' operations due to external challenges posed by government agencies and private litigants.

Notably, the White Collar group is made up of trial lawyers who routinely test the government's proof in complex trials where the stakes – a client's personal freedom or a corporation's survival – could not be higher. In 2008, in addition to representing a number of business entities in investigations, Cooley attorneys successfully defended clients at trial in three high-profile criminal prosecutions in New York, San Francisco and San Diego, and obtained a reversal of a securities fraud conviction on a federal appeal in New York.

Our team has handled a broad range of criminal and regulatory matters and conducted internal investigations across industries and borders. Additionally, we have extensive experience representing clients in parallel matters and are adept at handling the unique issues they present. We approach each case by analyzing the client's specific problem, predicting with some certainty the likely course that the investigation will take and developing a strategy that delivers the best results possible. If the matter goes to trial, we have the ability to explain our client's case to a jury in a manner that leads to a better understanding on our terms.
