Hacker Mock Trial

Mari Dugas, a cyber/data/privacy associate at Cooley, will be featured in this session alongside Harvard Law School JD candidate Emma Plankey and Atlantic Council fellow Winnona DeSombre, who’s also a Georgetown University Law Center JD candidate and Harvard Kennedy School Master of Public Policy candidate.

Attendees can serve as members of the jury as lawyers prosecute and defend a hacker (live on the stand) in two fictional scenarios. One scenario involves a federal criminal trial against a researcher deploying a guerrilla patch at scale, while the second scenario involves a civil suit against a company that produces offensive security tooling that has been misappropriated by bad actors. This session will provide a fun, casual way for hackers to think about their own risk posture, as well as provide insights into how lawyers are considering legal liability in tip-of-the-spear infosec conduct.
