The theme for 2024 is “Dispute Resolution in an Uncertain World,” focusing on the importance of the rule of law to democratic norms. With such uncertainty worldwide in terms of political and civil instability, how can the rule of law be preserved and protect a free world?

United Nations Commission on International Trade Law (UNCITRAL) Working Group V Update Panel
As the core legal body within the UN system in the field of international trade law that deals with insolvency law, the UNCITRAL Working Group V (Insolvency) has been working on two projects that aim to harmonize, modernize, and unify international trade law in insolvency and restructuring. The first project is a model law on the applicable law in insolvency proceedings (APL), which seeks to provide rules for determining the law that governs the commencement, conduct, administration, and closure of insolvency proceedings and their effects. The second project is a descriptive, informational, and educational text and toolkit on civil asset tracing and recovery in insolvency proceedings (ATR), which seeks to consolidate and expand the existing UNCITRAL insolvency framework and to present tools that enable urgent ATR measures across borders.
Hosted by IWIRC Europe, this panel provided an overview of the main features and challenges of the APL and ATR projects, as well as the potential benefits and drawbacks of their adoption and implementation in different jurisdictions. The panelists, who are delegates to the UNCITRAL Working Group V and represent different international legal and procedural systems, also shared their insights and perspectives on the future of insolvency and restructuring law at the global level.
