As we approach the deadline for bringing charges under the applicable statute of limitations, here is an interesting inside account of the SEC's decision-making process in connection with its determination not to take any action against Lehman Brothers or its top executives for their activities and omissions leading up to the 2008 financial collapse and Lehman bankruptcy. The article quotes SEC Chair Mary Schapiro telling the head of the SEC's Lehman investigating team: "I don't get it…Why is there no case? ….The world won't understand."
