Cooley lawyers Patrick Gibbs, John Dwyer, Brett De Jarnette, Samantha Kirby and Amie Simmons earned a spot on The American Lawyer’s Litigation Daily Litigator of the Week Runners-Up and Shout Outs list when the US Court of Appeals for the Ninth Circuit upheld the dismissal of securities fraud claims against BioMarin Pharmaceutical.
In the case, plaintiffs alleged that the company made false or misleading statements regarding the status and development of one of the company’s gene therapy drug candidates. The Ninth Circuit affirmed dismissal, holding that the plaintiffs failed to adequately plead a false or misleading statement.
