Mike is a commercial litigator, representing a range of clients in various disputes, including antitrust, products liability, regulatory and general litigation matters. He also represents aviation clients in litigation and counseling, concentrating on aircraft manufacturers, airports, operators and airlines.
Mike’s representative matters include:
Aviation products liability
- Representing a top helicopter manufacturer in multiple wrongful death lawsuits worldwide, securing a dismissal on the pleadings in one such suit and favorable results in others
- Defending an aircraft manufacturer in multiple civil suits involving high-profile military aircraft mishaps
- Advising drone and helicopter manufacturers and operators on products liability and other matters
- Representing an aircraft manufacturing conglomerate in a nationwide products liability action involving hundreds of individual plaintiffs
Antitrust litigation
- Representing an airline at trial in defense of its planned merger challenged by the US Department of Justice under Section 7 of the Clayton Act
- Representing a national trade organization in multiple federal lawsuits alleging violations of the Sherman Act and state antitrust laws
General litigation
- Representing a foreign bank in a Racketeer Influenced and Corrupt Organizations Act (RICO) suit in federal court, securing a favorable summary judgment decision and a subsequent favorable settlement for the bank client on the eve of trial
- Representing a celebrity family in a nuisance suit brought by a plaintiff seeking an opportunistic settlement, securing a dismissal with prejudice on the pleadings in federal court
- Representing an intellectual property (IP) licensing firm in an arbitration involving a contract dispute with a technology licensor
Regulatory
- Representing a regional airline challenging multiple regulatory actions taken by the Federal Aviation Administration (FAA), including safety investigations and certification challenges
- Drafting an amicus brief in a federal court of appeals challenge to the US Department of Transportation’s adopted Enhancing Transparency of Airline Ancillary Service Fees regulation
Before pursuing a career in law, Mike served for more than nine years as a US Marine Corps attack helicopter pilot. His experience as a military aviator provides a deep understanding of aviation equipment manufacturers and operators, which informs his representation of domestic and foreign manufacturers, US Department of Defense contractors, domestic air carriers, and airport sponsors. Mike is also a licensed rotary-wing and fixed-wing pilot.
Additionally, Mike worked for more than three years at Amazon as a senior program manager for three logistics technology products in use worldwide – managing technology launches to internal and external customers in a dozen countries.
