Fourth Circuit Rules Damages Cap in Charlottesville Mayhem Case Applies for Each Plaintiff

Cooley partner David Mills was quoted in Law.com on the US Court of Appeals for the Fourth Circuit’s affirmation of the jury’s verdict relating to the Charlottesville “Unite the Right” rally in 2017. The jury verdict found that defendants are jointly and severally liable for the damages caused during the rally. The court reversed the district’s decision capping punitive damages at $350,000 for the entire case, finding instead that Virginia’s punitive damages cap should be applied on a per-plaintiff basis, reinstating $2.8 million in punitive damages.
