About Bingxin

Bingxin has a broad practice in complex commercial litigation, appeals, government and internal investigations, and international arbitration. She represents individuals and companies in high-stakes commercial disputes in a wide range of areas – including securities class actions, shareholder derivative litigation, contractual disputes and tort claims. Bingxin also frequently represents individuals and companies in internal investigations and criminal and regulatory matters involving the Department of Justice (DOJ), the Securities and Exchange Commission (SEC) and the Financial Industry Regulatory Authority (FINRA). She has represented public and private companies across a variety of industries.

Bingxin’s representative matters include:

Commercial litigation

  • Defending a global financial services and brokerage firm against breach of fiduciary duty claims arising from a corporate reorganization in the Delaware Court of Chancery
  • Defending a fintech company and its directors and officers in a securities class action in the US District Court for the Southern District of New York and in a shareholder lawsuit in the Delaware Court of Chancery
  • Representing a premier electric car company, along with its current and former directors and officers, in defending a securities class action in the US District Court for the Northern District of California arising from a potential going-private transaction
  • Achieving successful dismissal of a securities class action against Immunovant and its directors and officers in the US District Court for the Eastern District of New York
  • Achieving successful dismissal of a securities class action against Meredith Corporation, and its current and former directors and officers, in the US District Court for the District of Iowa and in the US Court of Appeals for the Eighth Circuit
  • Achieving successful dismissal of a breach of contract and fraud action against a securities trading business and its equity holders in New York state court

Government investigations

  • Defending a social media company in state attorney general investigations
  • Defending a telecommunications company in SEC, DOJ and state attorney general investigations

Pro bono

  • Obtaining a favorable settlement for a Chinese American scientist for her wrongful prosecution and termination from her job
  • Representing the New York Legal Assistance Group in Freedom of Information Act (FOIA) litigation against federal agencies
